These Terms and Conditions (“Terms”) govern your use of the Antique Rogue® Suits website (the “Site”) and any related services provided by Antique Rogue® Suits (“we” or “us”). By accessing the Site or purchasing our products, you agree to be bound by these Terms. If you do not accept these Terms, do not use this Site.
Section 1 – General Terms
1.1 These Terms constitute the entire agreement between you and Antique Rogue® Suits.
1.2 We may amend these Terms at any time by posting the amended terms on the Site. Continued use of the Site after any changes means you accept the new Terms.
1.3 You must be at least 18 years or older to use the Site or make purchases. Use by minors is prohibited.
1.4 Site access may be terminated at any time without notice for any unauthorized usage. We reserve the right to refuse service or terminate accounts at our sole discretion.
1.5 All prices and items listed on the Site are subject to change without notice. Prices shown include VAT where applicable.
Section 2 – User Accounts
2.1 To place orders on the Site, you must register and create an account. You agree to provide accurate information and keep it updated.
2.2 You are responsible for account security and activity. Do not share your password or allow account access by others.
2.3 You must have permission to use any credit card or payment information provided on the account.
2.4 You agree to promptly update your account if credit card information changes to avoid declined payments.
2.5 We are not liable for losses incurred due to unauthorized account use or your failure to timely update account information changes.
Section 3 – Order Process
3.1 All order submissions are considered offers to purchase, subject to confirmation and availability. Receipt of payment alone does not constitute our acceptance of an order.
3.2 We reserve the right to refuse or cancel orders at any point, even after confirmed, for reasons like inaccurate information, supply issues, payment problems, etc.
3.3 For custom or made-to-measure orders, you may need to attend an in-person fitting. Failure to do so may result in order delays or cancellation if sizing is inaccurate. Additional fitting fees may apply.
3.4 Sizes, fabrics, construction, and other product details can vary slightly from descriptions on the Site.
3.5 For made-to-order and bespoke products, you will be required to sign an order form approving the final order details. This is considered your acceptance of the finished product.
Section 4 – Pricing and Payment
4.1 All prices shown are in Pounds Sterling. We make efforts to display accurate pricing, but errors may occur. If we discover a pricing error, we may cancel or update the order price.
4.2 Applicable VAT, taxes, and shipping costs are added at checkout based on your shipping address and payment info.
4.3 We may change prices at any time but will not alter prices for orders already placed and confirmed.
4.4 Promo codes, discounts, and gift cards are applied on qualifying orders at checkout. Offers are subject to specific terms that will be provided.
4.5 Payments by credit/debit card and authorized PayPal account are accepted. All charges are processed upon order confirmation.
4.6 For unprocessed payments, we will attempt to contact you using the contact information on file. If issues cannot be resolved promptly, the order may be cancelled.
Section 5 – Delivery
5.1 We will make best efforts to fulfill delivery times provided, but quoted times are estimates only. We are not liable for delivery delays.
5.2 Delivery is completed upon receipt by you or a person at the shipping address provided. Proof of delivery from our courier constitutes binding evidence of completion.
5.3 You are responsible for providing a valid shipping address, checking delivered items immediately, and notifying us of problems within 24 hours.
5.4 Customs fees, import taxes, or duties for international shipments are your responsibility. We have no control over these charges.
Section 6 – Returns and Refunds
6.1 Custom and made-to-order items cannot be returned or exchanged unless found to be faulty or inaccurate to your approved specifications.
6.2 For standard returns, notify us within 14 days of receiving your order. Items must be unused with tags still attached. You will be responsible for return shipping fees.
6.3 Refunds are processed once returned items are inspected and restocking fees may apply. Refund methods will match the original payment.
6.4 You must comply with our Returns Policy published on the Site when sending items back. All information therein is incorporated into these Terms.
6.5 Damaged or missing items must be reported within 24 hours of delivery and documented. Claims outside this window will not be eligible for refund or replacement.
Section 7 – Our Liability
7.1 We will not be liable for delays or errors where: (a) there are factors outside our reasonable control; (b) delays result from your actions or inactions; or (c) you fail to comply with applicable law, Terms, or policies.
7.2 To the maximum extent permitted by law, our total liability for damages arising from Site use will not exceed the amounts paid to purchase the relevant products on the Site.
7.3 We will not be liable for indirect, special, incidental, punitive or consequential losses or damages. Our maximum liability for any reason is limited to the amount paid to us in the 12 months before the first incident giving rise to the legal claim.
7.4 You assume full responsibility and risk of loss from use of this Site. The information provided about products is not professional advice or a warranty. All purchases are made at your discretion.
Section 8 – User Conduct
8.1 You agree not to use the Site or services in any way that: (a) harms us or any other party; (b) violates applicable laws; (c) is abusive, harmful, or fraudulent; or (d) interferes with the Site’s proper functioning.
8.2 You will not upload or transmit any material that contains viruses, malware, or destructive features on the Site.
8.3 All content submitted to the Site must comply with applicable laws and our policies. You grant an unrestricted license to use submitted content as we deem appropriate.
8.4 Any unauthorized copying, distribution, modification or creation of derivative works from Site content is prohibited.
Section 9 – Intellectual Property
9.1 The Site structure, organization, code, design, logos, text, and images are owned by us or our affiliates and licensors. All other trademarks are the property of respective owners. Use without permission is prohibited.
9.2 You acknowledge our intellectual property rights and all rights reserved to the Site materials and services. Nothing grants you transfer of ownership or license to use our intellectual property.
9.3 User feedback does not constitute Intellectual Property rights. However, any comments, suggestions or materials sent to us will be treated as non-proprietary and can be used for any purpose.
Section 10 – Indemnity
10.1 You will fully indemnify, defend and hold us harmless, along with employees, officers, directors, and suppliers, from any claims arising from: (a) your use of the Site; (b) your breach of these Terms; (c) your violation of applicable laws/rights; or (d) your submitted content.
10.2 You will reimburse all losses, damages, liabilities, and costs incurred relating to such claims. We reserve the right to assume exclusive control of defending any claim subject to indemnification by you under this Section.
Section 11 – General Provisions
11.1 We may provide notice to Users by posting it on the Site, emailing it to the address in your account, or mailing it to the address in your account throughout the Terms. All notices to us must be sent by post to Antique Rogue® Suits, 35 Kingsland Road, London E2 8AA, United Kingdom.
11.2 Our failure to enforce strict performance of any provision herein will not constitute a waiver.
11.3 We do not guarantee the Site will operate without disruption, errors, or data loss. You must back-up content and data used on the Site.
11.4 If any provision herein is deemed unenforceable, the remaining provisions will continue in full force.
11.5 These Terms are governed exclusively by English law and any disputes will be subject to the exclusive jurisdiction of the English courts. However, we retain the right to pursue remedies in any jurisdiction worldwide, including for unlawful use of our intellectual property.
Section 12 – Online Purchases
For online purchases, the following additional terms apply:
12.1 You warrant that all billing and shipping information provided is accurate and complete and that credit/debit card use is authorized.
12.2 Delivery dates given refer to estimated processing times once the order leaves our facilities. Delivery times do not account for potential delays by customs, carriers, inclement weather, etc. We cannot declare orders lost until after 30 business days.
12.3 Risk of loss transfers upon our shipment to the carrier. However, title does not transfer until fulfilment is satisfactorily complete.
12.4 Software or digital content available for purchase may have additional license terms that require acceptance prior to obtaining access. Use indicates agreement to those terms.
12.5 Where accessories or packaging must be omitted or altered to ship products internationally, no refunds will be given for their lack or non-original form.
Section 13 – Returns for Online Purchases
13.1 Online purchases are eligible for refund only when returned in new, unused condition with original tags/packaging within 14 days. Custom-made items cannot be returned unless inaccurate or faulty.
13.2 You will be responsible for paying for your own shipping costs for returning items back to us. Shipping costs are nonrefundable.
13.3 We recommend using recorded/tracked shipping when returning items to us. We cannot be held liable for returns lost in transit.
13.4 Once your return is received and inspected, we will send you an email confirmation. Refunds may take 1-2 billing cycles to appear based on your payment method.
13.5 All product promotions, discounts, gifts, free additions/enhancements, or other incentives offered at time of purchase are void upon return.
13.6 Exchanges are treated as a return and new purchase. You must first process a return under our Policy. If you are instead opting to exchange, please place a new order for the exchange product.
